FUNCYCLES CANNON BEACH LLC
BICYCLE AND BEACH EQUIPMENT RENTAL WAIVER AND RELEASE OF LIABILITY
This Waiver and Release of Liability (the “Agreement”) is entered into by the undersigned (the “Renter”) in favor of FunCycles Cannon Beach LLC, its owners, employees, agents, and affiliates (collectively, the “Company”).
1. Acknowledgment of Risk
I, the undersigned, acknowledge that the use of bicycles and tricycles, trailers, beach chairs, umbrellas, beach toys and games, beach chairs, beach wagons, and other related equipment (collectively, the “Equipment”) involves inherent risks, including but not limited to physical injury, property damage, and in rare cases, death. I voluntarily assume all such risks, whether foreseen or unforeseen.
2. Use of Equipment
I agree to:
- Use the Equipment in a safe and responsible manner.
- Wear appropriate safety gear (e.g., helmets for bicycles) at all times.
- Abide by all traffic laws and beach regulations.
- Not allow any unauthorized persons to use the Equipment.
3. Condition and Return of Equipment
I accept full responsibility for the Equipment while it is in my possession. I agree to return it in the same condition in which it was received, reasonable wear and tear excepted. I will be responsible for the cost of repairing or replacing Equipment that is damaged, lost, or stolen during the rental period.
4. Release and Waiver
I hereby release, waive, discharge, and hold harmless the Company from any and all claims, damages, losses, liabilities, or expenses arising from or related to the rental or use of the Equipment, including injuries or accidents, regardless of whether such injuries or damages are caused by the negligence of the Company.
5. Indemnification
I agree to indemnify and hold the Company harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my use of the Equipment.
6. Minor Participants
If the Equipment is being rented for use by a minor, I certify that I am the parent or legal guardian and accept full responsibility for the minor’s safety and compliance with the terms of this agreement.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon.
